Found a newly built home that we fell in love with - we thought a new build shouldn' be too much involved so we used the Tri County Realtor listing the home to represent both parties. We accepted and signed the purchase agreement and set a closing date 30 days after signing but discovered the home didn't have Tarion New Home Warranty (which is Ontario Law since 1976).. Our realtor said he didn't know much about Tarion and that we didn't need it. After discussing Tarion and laws the realtor and builder agreed to obtain Tarion warranty on the home and we signed an amendment that the builder would do this.. We didn't get much info after that unless we made the effort and very little information after that.. Over 4 months after our original closing date we get a notice from our lawyer with a new closing date but the amendment to purchase has a brand new building company name ? and just a Tarion Registration number for that company not the house (so if we would have signed that amendment we would of had no warranty).. When brought up to the realtor and asked if the house was warrantied he said he doesnt know eventually he told us no!! -- the amendment wasn't put thru and once again waiting on a builder to some how correct his wrongs along with the reality listing a new build without Registering with Tarion..
A month later (7 months almost after the original closing date before we called the realtor out and brought the Tarion to his attention) we sat down with the realtor and asked when will the builder and the home be registered -- his response was you are bound the the Purchase Agreement so you just have to wait until he gets it? Angry with the lack of professionalism from the realtor, builder and all other parties involved (we were the ones researching and bringing all the issues up to the people who do this as their career) and to add to the mess our lawyer closed our file after the new builder company name was one the 2nd amendment and closing date set.. (basically saying they are not a litigation firm)..
We no legal counsel and using the realtor selling the house (Tri County) and trapped in a home purchase that was over 6 months in we thought the only way out was to ask for a mutual release at the end of December after our meeting with the realtor who basically said you have to wait.. (we are lucky we didn't sell our home when we signed the original purchase agreement 6 months prior or we would have been living I dont know where with added cost I wouldn't want to think about)..
After getting the Mutual Release from the property our condition were to find a lawyer to ensure the paperwork was all in order..
We were unable to find a lawyer to view the mutual release before the paperwork date expired and when we found one the lawyer said the mutual release should reflect the original paperwork not what was on the mutual release?
10 months after the original signing on the purchase agreement my ex lawyer sends me info saying another new builder name (3rd company now) is on the home and it is registered along with thos new company and they set the info to their lawyers office by mistake (being they removed themselves 4 months prior to the purchase)..
With discussions back and forth with the realtor and mentioning that we weren't interested but still were in a contract came to the conclusion (after contacting and verifying withTarion myself to verify that this newly formed 3rd Company was registered with the home and that the home was registered) that we still loved the property and the home and were discouraged by the builder and realtors actions!! and agreed with the realtor to go ahead with the purchase. We set a date to meet and sign the new amendment to buy the house and set a quick closing date.. 3 hours before the meeting the realtor calls and cancels - then days later the we are told the builder after 10 months changed his mind and doesnt want to sell us the house!!
There is much more to this story but in reading this you can make the decision to use this realtor.. We still dont have a home 2 yrs later
